Updated: Judge Denies Request by Convicted Detroit Riverfront Conservancy Embezzler To Delay Reporting to Prison

Update: 11:15 p.m. Monday –U.S. District Judge Susan DeClercq on Monday denied a request from William A. Smith, former CFO of the Detroit Riverfront Conservancy, to delay reporting to prison on Tuesday due to a medical issue.

"This Court has already extended defendant’s report date by 60 days for him to receive medical treatment before reporting to the BOP (Bureau of Prisons)," the judge wrote in a ruling. "He received such medical treatment. Id. And he admits that the additional treatment he seeks 'might possibly be available' in the BOP.

"The the Government confirmed that the additional treatment is available through the BOP. Thus, he has not shown any basis to extend his report date a second time."

Smith was sentenced to 19 years in prison for embezzling more than $40 million from the nonprofit.

William A. Smith, former CFO of the Detroit Riverfront Conservancy who embezzled more than $40 million, wants to delay reporting to prison to begin serving his 19 year sentence.

His attorneys Gerald Evelyn and Robert Higbee asked that U.S. District Judge Susan DeClercq delay his reporting date and keep their motion under seal because it contains "sensitive, personal medical information. "

Judge DeClercq approved the motion. He is scheduled to report to prison Tuesday, Aug. 12. 

In a presentencing report in April, Smith said:

“I want the judge to know that I am extremely remorseful and want the opportunity to work to get the victims as close to whole as possible. I am ashamed of what I’ve done to the city and the project that I love. This behavior is something I will never repeat. My intentions are to continue working to restore the trust and respect of the community that I let down.”
